Commitment evidence: the aspect with no obvious paperwork

Financial, household and social aspects each have obvious paperwork attached. The fourth does not, which is why it is the one most often left thin — a couple can have joint accounts, a joint lease and a wide social circle and still have documented nothing under this heading.

What the regulation names

(d) the nature of the persons’ commitment to each other, including: (i) the duration of the relationship; and (ii) the length of time during which the persons have lived together; and (iii) the degree of companionship and emotional support that the persons draw from each other; and (iv) whether the persons see the relationship as a long-term one.

Documents that name the partner in a lasting way

Published guidance consistently points to a particular kind of document here: records created for reasons entirely unrelated to a visa, in which one partner has already treated the other as their closest person.

  • A will naming the partner as beneficiary, executor or both — described across published guidance as the most consistently cited single item under this heading, precisely because it is a formal legal document executed for an independent purpose.
  • Superannuation and insurance beneficiary nominations naming the partner, held on record by the fund or insurer.
  • A marriage certificate, or for prospective marriage applicants evidence of the engagement and the intention to marry.
  • A registered relationship certificate from a state or territory relationship register.
  • Enduring power of attorney naming the partner, and guardianship arrangements for children.
  • Emergency contact and next-of-kin nominations — on employment records, health insurance, medical records, school enrolments. Published guidance notes these are commonly already in place and need nothing new to be created.

Time apart, and the records that cover it

Almost every relationship has periods apart, and for couples applying from offshore the separation may cover most of the relationship. Published guidance describes communication records as the material that covers those gaps, because they are the only kind of evidence that can document a relationship being actively maintained rather than dormant across a period when nothing else was shared.

Plans with something attached to them

The fourth sub-element asks whether the couple see the relationship as long-term. Published guidance describes documented plans as carrying this where something concrete is attached to them — a saved property listing, a booking, correspondence about the plan, a savings account with a stated shared purpose — rather than the plan existing only as an assertion in a statement.

The relationship story

Every source reviewed treats a written, chronological account of the relationship as expected: how the couple met, how it progressed, the milestones, any periods apart and how they were managed, and where things are heading. It is not one of the four sub-elements, and published guidance is explicit that it does not replace documents. What it does is give the documents somewhere to sit — a will, some message logs and a savings account read as unconnected items without an account tying them to one relationship.

Prospective marriage applicants

For subclass 300 the equivalent question is forward-looking — the intention to marry and to live together — rather than a long shared history. Published guidance describes evidence of the engagement, concrete wedding planning, and documented plans for living in Australia as covering this aspect, with the absence of a long cohabitation history treated as an expected feature of the category rather than a gap.
